The Logic of Resistance

By William C. Carlotti

April 14, 2009

It should be apparent that the problem in Palestine is not just simply a problem of checkpoints, human rights abuses, the wall, home demolitions, the architecture of occupation or even the siege of Gaza; the core of the problem is the illegal theft, colonization and occupation of a whole country.

These are only symptoms of the Jewish nationalism expressed in the cancerous ideology called Zionism. It is an ideology that has been organized into the World Zionist Organization with branches in all of the countries of Europe, in the United States and in dozens of other countries ranging from Australia to Mexico to South Africa. The Organization held its 35th Zionist Congress in 2006 in Jerusalem with some 2000 delegates and observers from all over the world. 510 delegates participated in its proceedings including 145 delegates from the United States.

Christian Zionist support, however, unlike the international World Zionist Organization, is principally centered in the United States. In concert with the American Israeli Public Affairs Committee (AIPAC), the Anti-Defamation League (ADL), and the Conference of the Presidents of Major American Jewish Organizations (52 Org.) they constitute an enormously well-funded confluence with the Bush/Cheney neocon cabal led United States government's drive for hegemony over the oil and gas reserves of the middle east and the Caspian Sea for the United States based international oil, gas and finance conglomerates.

This organized international Jewish Zionist support centered in the World Zionist Organization is critical to the Jewish Zionist led, Christian Zionist supported Israeli government that has been on a 60-year messianic mission to acquire the whole of Palestine and parts of Egypt, Jordan, Syria, and Lebanon, which they describe as "Eretz Israel".

According to the Zionists, "Eretz Lsrael" is described in that book of short stories that has become known as the bible in Genesis 15:18-21, Ezekiel 47:13-20 and similarly in Numbers 34:1-15, descriptions which have been adopted by the Jewish Zionist led Israeli government.

According to Prime Minister Ehud Ohmert of Israel in his address before a joint meeting of a genuflecting United States Congress on a May 24 of 2006 Address to Congress,

"For thousands of years, we Jews have been nourished and sustained by a yearning for our historic land. I, like many others, was raised with a deep conviction that the day would never come when we would have to relinquish parts of the land of our forefathers. I believed, and to this day still believe in our people's eternal and historic right to this entire land."

What is not often mentioned is the fact that this biblically defined land that the modern day Jews claim as their "entire land" was acquired, according to the short story accounts of their claimed ancestors, by the genocidal slaughter of the peoples of seven other nations that occupied the land that these modern Jews now claim by "historic right".

The description of this completed genocidal slaughter is the only known written admission of genocide by any of the perpetrators of genocide in recorded history. Even the nazi led German government and the European colonialist led United States government never deigned to produce a written admission of the genocides that they were engaged in. The following are some of the descriptions of this genocide by the ancestors claimed by Olmert and the whole of the Jewish Zionist led government of Israel.

"In Deuteronomy 7:1-36, ".the Lord thy God shall have destroyed many nations before thee, the Hethite, and the Gergezite, and the Amorrite, and the Chanaanite, and the Pherezite, and Hevite, and the Jebusite, seven nations much more numerous than thou art,.thou shalt utterly destroy them. Thou shalt make no league with them, nor show mercy to them: and shall slay them until they are utterly destroyed...and thou shalt destroy their names under heaven: no man shall be able to resist thee, until thou destroy them." GAZA -- After spending 6 years in Israeli detention-center,political prisoner Shirin Ash-Sheikh Khalil, from Ramallah in the West Bank was transferred via Erez crossing to Gaza,to were Israeli authorities sent her, instead of releasing her to her family on the West Bank.

The Israelis refused to let the Palestinian prisoner Shirin Ash-Sheikh Khalil rejoining with her family home in Ramallah after she spent 6 year in an Israeli detention facility, Shirin was deported to Gaza Strip, where she met with her mother.

Shirin Ash-Sheikh Khalil, born in Gaza in 1985 moved with her family to the West Bank in 1998. In 2003, when Shirin was 18 years old, she was apprehended by the Israelis ,and sentenced to 6 years in Israeli jail, which full time she had served on Sunday.

In Gaza, a researcher and spokesperson for Palestinian prisoners asserted that the Israelis has deliberately deported political Palestinian detainees to the Gaza Strip and to Jordan under different pretexts, one for not having a West Bank ID card, another, failing family reunification rules.

Eight political Palestinian prisoners which had served their time in Israeli prison facilities were sent to Jordan a few days ago, and back in 2002 when the Church of Nativity were besieged by 26 West Bank residents, they were deported by the Israelis to Gaza Strip

Call From Gaza

Please forward widely....

Dear Everyone:

Please take a few minutes to read the call-out below from a broad Gaza-based prisoner solidarity campaign made up of a coalition of prisoner rights groups, local and international activists, prisoner families and Ministry of Detainees representatives in Gaza.

Friday April 17th is the international day of solidarity with Palestinian prisoners. Just over 11,000 are behind bars in occupation prisons inside the apartheid lines and outside the ghetto walls of the West Bank and Gaza.

Prisoners are a community under siege which represents every faction in Palestine. Solidarity between prisoners inside Israeli jails crosses all political borders. They have sacrificed their individual freedom for collective freedom.

From taking direct action to symbolic gestures (in the case if prisoner campaigns, simple visual solidarity gestures drawing public attention to the struggle of prisoners is always effective in keeping memories, spirit and solidarity alive). Please take action this week! And email us about it...

April 17th is the international day of solidarity with Palestinian prisoners. These over 11,000 men, women and children are ghost prisoners, forgotten by the international community and media which has focused on the systematic and physical psychological torture of prisoners in high profile camps such as Guantanamo Bay but has largely ignored the network of Israel's 'Guantanamos' inside 'Israel'.

********

This call comes from Gaza – recognized as a large open air prison and place of punishment and exile for Palestinian prisoners from the West Bank.

Maximum security facilities such as Nufha, Haderim, Jalamy, and Ashkalon , and so-called 'black sites' which the Israeli government refuses to acknowledge, hold thousands of Palestinian prisoners. These prisoners are regularly and systematically tortured, denied access to legal representation, family visits, education, shelter, light, essential medical care and medicines.

The 'Israeli state' has a policy of administrative detention which means any man, woman or child can be arrested at any time and in any place and incarcerated without trial or access to any alleged evidence held by the intelligence services, for an undetermined and extendable length of time.

The majority of Palestinian men has been and will be arrested and incarcerated at some point in their lives by Israeli occupation forces. Under the Fourth Geneva Conventions, which Israel is a signatory to, Palestinian prisoners should be treated by the occupying forces under the rules applicable to the treatment of civilians in time of war.

Almost all the Palestinian detainees are held in jails away from the West Bank (including East Jerusalem) and Gaza Strip, in violation of international humanitarian law, which bars the removal of detainees to the territory of the occupying power. The 'Israeli' military and security forces regularly violate international law and conventions relating to prisoners.

Imprisonment and torture is an intergenerational experience for Palestinians living in Gaza, 1948 Palestine ('Israel') and the West Bank.

Imprisonment is a core element of the Israeli occupation's strategy of collective containment and punishment of the Palestinian population – both of those jailed, and their families who suffer their absence and wait for their release. Military resistance fighters, as well as non-militarily active political activists, community organizers, paramedics, doctors, journalists, teachers, and students are regularly jailed under an Israeli legal framework which criminalizes any form of resistance to occupation

The inhumane prison conditions that Palestinian prisoners endure are steadily deteriorating. Following the Gaza massacres, the collective punishment of prisoners from Gaza has accelerated, with prisoners being denied the right to newspapers, radios, phone calls and visits from legal representatives. Gazan prisoners are now being confined to their cells for up to 23 hours a day and are being classified as "enemy combatants" further stripping away any rights to legal defense.

Palestinian prisoners are a forgotten community behind bars, often locally referred to as 'living martyrs'. The prisoner issue is a core part of the Palestinian struggle, whose liberation is as integral to the struggle for justice and peace as the return of refugees, Jerusalem and stolen land.

In Gaza we will be holding a week of activities in solidarity including a marathon through the streets of Gaza in solidarity with our jailed loved ones, a conference of all prisoner advocacy organizations and prisoners' families, a mass demonstration and a celebration of Palestinian resilience, sacrifice and patience.

In the light of 'Israel's' further shift to the far right, unchallenged impunity, and the intensified humiliation of Palestinian prisoners, we call on the international community to take a stand.

We call for an end to double standards and for international pressure to force 'Israel' to adhere to international law.

We call on national representatives, parliamentarians, human rights organizations, trade unions, activists and people of conscience throughout the world to recognize, remember, speak out and protest the treatment of Palestinian prisoners this week.

We hope this week will be the catalyst that sparks long-term campaigns and commitments towards solidarity with Palestinian prisoners.

Israel Must Be Punished in War Trial

Karen Sorensen

April 10 2009

Charges by Israeli soldiers prove that the Israelis 22 day long assault in Gaza Strip gravely violated international law. Mean while the Israelis suggest that there might be more violations on the Gaza Strip, Israeli officials dispute some of the accounts of their soldiers, but evidence suggests that the Israeli army committed the following violations against international law:
* Israeli military violated its duty to protect civilian population of Gaza Strip. Despite the Israelis “disengagement” from Gaza in 2005, the Gaza territory remains occupied. The Israelis unleashed its military weaponry against a people it is legally bound to protect.

• The Israelis imposed collective punishment in violation of Article 33 of the Fourth Geneva Convention. After Hamas took over the power in Gaza Strip in June 2007, the Israelis imposed suffocating restrictions on trade and movement. The blockade is an act of war in customary international law has plunged the population into poverty and malnutrition, sick and wounded patients are denied access to medical treatment. People in Gaza thus faced The Israelis onslaught on the population during the cold winter months winter has further weakened the conditions.

• The Israelis deliberately attacked civilian targets. The laws of war permit attacking a civilian object, but only when it is making an effective contribution to a military action and a definite military advantage is gained by its destruction. Yet an Israeli general, Dan Harel, said, “We are hitting not only terrorists and launchers, but also the whole Hamas government and all its wings.” An Israeli military spokesperson,Avital Leibovich, avowed that “anything affiliated with Hamas is a legitimate target.” Israeli war machinery destroyed or damaged mosques, hospitals, factories, schools, a sewage plant serving the territory, institutions like the parliament, the main ministries, the central prison, the police academy ( during an inauguration cermon, hundreds of policemen were killed in this attack) police stations and thousands of private homes were destroyed.

• Willful killing of civilians without military justification. When civilian institutions were targeted, civilians who were not members of an armed party, and not taking direct part in hostilities were killed. The international law authorizes killings of civilians if the objective of the attack is military, and the means are proportional to the advantage gained. Yet in proportion to the Israelis war machine it is irrelevant if the targets were not military to begin with. Gaza government employees — traffic policemen, court clerks, secretaries and others — are not combatants merely because Israel considers Hamas, the governing party in Gaza, a "terrorist organization". Many countries do not regard violence against foreign military occupation as terrorism.

Of the 1,434 Palestinians killed in the Gaza invasion, 960 were civilians, including 121 women and 289 children.According to a United Nations special rapporteur, Richard Falk Israeli military lawyers instructed army commanders that Palestinians who remained in a targeted building after having been warned to leave were “voluntary human shields,” therefore combatants. Israeli gunmen“knocked on roofs” before hitting more vulnerable points — to “warn” Palestinian residents to flee.

With nearly all that existed in the densely populated Gaza Strip blocked by Israel, and the chaos reigning within it, this was a particularly cruel flouting of international law. Willful killings of civilians that are not required by military necessity are considered grave breaches of the Geneva Conventions, and war crimes under the principles of Nuremberg.

• Deliberately employing disproportionate force. Last year, Gen. Gadi Eisenkot, head of Israel’s northern command, speaking on possible future conflicts with neighbors, stated, “We will wield disproportionate power against every village from which shots are fired on Israel, and cause immense damage and destruction.” Such an noticeable admission of illegal intent would constitute evidence in a criminal prosecution.

• The Israelis Illegal use of weaponry including white phosphorus. The Israelis first lied but was finally forced to admit that it employed white phosphorous across the Gaza Strip, though they defended its use as legal. White phosphorous may be legally used only as obscurant bank of clouds, not as a weapon. White phosphorous burns deeply into tissues and bones and is extremely difficult to extinguish. Israeli political and military personnel who designed, ordered or executed these possible offenses should face criminal prosecution. The appointment of Richard Goldstone, the former war crimes prosecutor from South Africa, to head a fact-finding team into possible war crimes by both parties to the Gaza conflict is an important step in the right direction. The stature of international law is diminished when a nation violates it with impunity.
